RESUMO
O trabalho enfoca o papel do Juiz na busca incessante pela pacificação social, escopo maior da Jurisdição, tutelando os direitos, através da utilização de meios alternativos de solução de conflitos, mais precisamente a conciliação e mediação. Abordam-se as diferenças entre tais institutos, enfatizando a pouca aplicabilidade de ambos, em que pese a expressa previsão legal da conciliação - o que não ocorre com a mediação - principalmente pela autoridade judiciária. Prioriza-se a necessidade de que os Juízes se conscientizem que esses meios são mais eficazes, devendo o Poder Judiciário se estruturar melhor com esse objetivo, criando ambientes que propiciem a solução consensual dos litígios, despindo-se dos dogmas atuais que torneiam o tema.

The work focus the part of the Judge on the incessant picks by social pacification, scope major of the Jurisdiction, protecting the rights, through the utilization of alternatives to solution the conflicts specifically the appeasement & mediation. The differences that encircle the themes are approached, emphasizing the little applicability of both, although the conciliation theme is treated in the law- what it does not occur with the mediation - especially for the judiciary authority. It is necessary that the Judges have the conscience that these acts are more efficient, having the Judiciary Power to structuralize with this objective, creating environments to give the consensual solution of the litigations, undressing of the current dogmas that tilt the subject.
